Throughout these terms and conditions, CCT will refer to CUSTOM CARE TRUST, LLC when referring to the company/business from which Custom Care Kits are purchased or to “customcaretrust.com” when referring to the Custom Care Trust, LLC website, as applicable.
PRODUCT PURCHASE AND RETURNS POLICY. You agree that purchasing a Custom Care Kit is for personal use only and that you will not duplicate or reproduce the download kit, which will be in the form of a zip file, or any components of that zip file, in any manner whatsoever or for any purpose other than personal use. You also agree that all of your purchases from CCT are final and cannot be returned or refunded.
PRIVACY. CCT will not divulge to a third party any personal information, such as your name, addresses, credit card information, or other personal information for any purpose. The only systems to receive your credit card information to process your purchase will be Paypal if you choose this method of payment or the credit-card processing merchant if you choose to pay without using Paypal. CCT may, however, from time to time contact you through your email address to request feedback on our products.
ELECTRONIC COMMUNICATION/REPRESENTATION. When you visit CCT or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. You agree that all agreements, notices, disclosures and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of any personal content.
COPYRIGHT AND TRADEMARKS. All content included on this site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of CCT and protected by international copyright laws. The compilation of all content on this site is the exclusive property of CCT with copyright authorship for this collection by CCT, protected by international copyright laws. Trademarks and/or trade dress of CCT may not be used in connection with any product or service not the property of CCT.
SITE ACCESS. CCT grants you limited access to make personal use of this site, but no portion of this site may be modified, reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of CCT. You may not use any meta tags or any other “hidden text” utilizing the name or trademarks of CCT. You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page of CCT as long as the link does not portray CCT or any of its associates, products, or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use any CCT logos or portions thereof or other proprietary graphic or trademark as part of the link.
LIABILITY. You expressly agree that your use of this site is at your sole risk. CCT does not warrant that this site, its servers, or email sent from CCT are free of viruses or other harmful components. CCT will not be liable for damages of any kind arising from use of this site, including but not limited to direct, indirect, incidental, punitive, and consequential damages. Certain state laws do not allow limitation of certain damages. If these laws apply to you, some or all of the above disclaimers or limitations may not apply to you, and you might have additional rights.
LEGAL GOVERNANCE AND DISPUTES. Your purchase of a Custom Care Kit confirms your agreement that the laws of the State of VERMONT (U.S.) without regard to principles of conflict of laws, will govern these Terms and Conditions and any dispute of any sort that might arise between you and CCT or its associates. Any dispute relating in any way to products you purchase from CCT shall be submitted to confidential arbitration in VERMONT (U.S.) except to the extent you have in any manner violated or threatened to violate the intellectual property rights of CCT. In that case CCT may seek injunctive or other appropriate relief in any state or federal court in the state of VERMONT, WINDHAM COUNTY ( U.S.), and you consent to exclusive jurisdiction and venue in such courts. Arbitration shall be conducted under the rules then prevailing of the American Arbitration Association, and arbitration awards shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
